Florida Limits Manufacturer Liability in Products Liability Cases
Florida recently passed legislation which requires Courts to consider evidence of everyone at fault for an accident and not just the manufacturer.
This new legislation, with the purpose of bringing business to Florida, is part of new Tort Reform measures recently taken in the state.
Critcs argue that this removes accountability on the part of manufacturers to make safe products. Before this bill, juries were not able to consider who caused the initial accident in a products liability cases.
Specifically, this legislation overturns a 2001 Florida Supreme Court case which held that juries could not consider the negligence of the person causing the initial accident.
It will be interesting to see if the bill serves its purpose of bringing jobs to Florida, or instead, limits accountability of manufacturers.
