8 Million Dollar Verdict Awarded To Plaintiff In Fosamax Trial
A jury in the United States District Court for the Southern District of New York found last week that Merck's osteoporosis drug Fosamax was defectively designed and unreasonably dangerous. The jury sent a strong message to Merck when they awarded $8 million in compensatory damages to 72 year-old Shirley Boles from Fort Walton Beach, Florida. Ms. Boles incurred serious, life threatening injuries after using Fosamax to combat osteoporosis; however, the jury found that instead of helping Ms. Bols that Fosamax caused her disabling and disfiguring disease, osteonecrosis of the jaw.
Lead counsel for the plaintiff, Tim O'Brien of the Levin, Papantonio Law Firm alongside co-counsel Gary Douglas gave Merck a huge loss in the Fosamax Products-Liability Litigation which has been going on for years.
Mr. O'Brien summarized the findings as follows: "This jury saw what we saw in Ms. Boles. She's the world's bravest great-grandmother and this horrible injury never should have happened to her. But it did, so she took on a giant. And she won."
