Former High School Student Files Suit Over Explicit Cell Phone Pictures

A high school graduate in Pennsylvania has filed a federal law suit claiming harassment due to her former principal taking her cell phone when he found "explicit" photographs of her on it.
The former student claims she was subject to unreasonable search and seizure, invasion of privacy, and that her First Amendment right to free expression was violated.

"I was absolutely horrified and humiliated to learn that school officials, men in the DA's office and police had seen naked pictures of me," said the former student (who has not been identified) through the A.C.L.U.

"Those pictures were extremely private and not meant for anyone else's eyes. What they did is the equivalent of spying on me through my bedroom window," she said.

The suit seeks unspecified damages against the School District, Ellsworth, Skumanick, the county, and others. It also asks for any law enforcement or prosecutorial office that may have a copy of her photos to turn over or destroy all copies of such.

Michael Healey, superintendent of the Tunkhannock Area School District, said he would have no comment until the district's legal representative had a chance to review the allegations.
