Pedestrian Killed After Being Struck On East Indian Trail In Louisville

Derrick L. Fuller, 36, was tragically killed early this morning when he was struck by a car in the 3800 block of East Indian Trail in Louisville. Police are reporting that the driver of the vehicle who struck Fuller left the scene, went home, and called police. Local news is reporting that the driver told police he dozed off, hit a curb, and then Fuller. No charges have been filed at this time.

Legal analysis by Louisville attorney Shawn Cantley: There are conflicting reports about what happened (that Mr. Fuller may have darted out into traffic), but it's always suspect when a driver leaves the scene of a collision without stopping and attempting to render aid.

It is also extremely important that people not drive when they are excessively fatigued. Even if Mr. Fuller was "jay walking," if the driver fell asleep at the wheel, then he bears at least some responsibility for Mr. Fuller's death.
