Legal analysis by Kentucky injury and wrongful death lawyer Shawn Cantley:
"Nearly every time a person is thrown from a vehicle in an auto accident, first responders conclude that they must not have been wearing a seat belt. While this is often the case, it certainly is not always true. There is a lot of recent data that suggests that seat belts do not always perform properly, often due to defective design of the belt itself or the posts that hold the shoulder strap. This is why it's imperative in the case of a serious injury or death to have a trained professional do a forensic analysis to determine if the victim was in fact wearing his or her belt."
