Morehead, Kentucky Car Wreck Kills One, Injures Two

A car wreck on Highway 32 in Morehead, Kentucky killed one woman and injured two others just after 9:00 a.m. on December 4, 2009.

Police say 33 year-old Brian Owens was driving a 2005 Chevy pickup when he slammed into the back of 42 year-old Traci Swartz's 1996 Chevy Blazer, which had slowed for a tow truck. Ms. Swartz was ejected from her vehicle and killed.

Owens, and Swartz's passenger, 21 year-old Daniel Moore, were rushed to the hospital. Local news is reporting that they were both treated and released with minor injuries.

She comments: "My heart goes out to Ms. Swartz's family. It appears she was a loving, devoted, mother and will be terribly missed. As a mother of two boys, I cannot imagine what the family must be going through. This is such a tragedy, and one that most likely could have been prevented if Mr. Owens was driving responsibly and paying attention. If it is discovered that Mr. Owens was negligent, he must be held accountable for his actions and will be liable to Ms. Swartz's children for damages resulting from their mother's death. In cases like this, where police are reporting that the victim was not wearing a seatbelt, it may be important to conduct an accident reconstruction to determine if that is truly the case. Often, an accident reconstruction can determine that the driver was actually wearing a seatbelt, but it failed upon impact."
