Update: On Fatal Crash Involving FedEx Truck

The truck crash in Verona, Kentucky involving a FedEx delivery truck and a pickup truck, which resulted in the deaths of three people, is suspected to have been caused by slippery road conditions. Additionally it has been reported that the three people killed in the accident were not wearing seatbelts. The driver of the FedEx truck, identified as Gary Hutchinson, was wearing his seatbelt and suffered only minor injuries. Those killed in the accident have been identified as 45 year old Tamara Roberts, of Warsaw, KY, her 11 year old son, and her 70 year old father, Dillon Roberts, of Dallas, KY. Tamara Roberts has been reported to have been the driver of the pickup truck. Initial reports are speculating that the pickup truck slid into oncoming traffic.

As reported earlier by wrongful death attorney , a partner in the firm of Bahe Cook Cantley & Jones,: "This is the ideal scenario where an accident reconstructionist may be necessary to figure out exactly why this crash happened the way it did. Many times people wait too long to get a reconstructionist involved, which can result in the loss of crucial evidence. Big companies like FedEx, or tractor trailer companies, have the resources to send reconstructionists to the scene before the police even clear it. And many times they do exactly that. Hiring a lawyer and an accident reconstructionist immediately allows for an evening of the playing field.”

Additionally, the fact that those killed in the accident were not wearing seat belts may give a foundation for a portion of the fault for the deaths from this accident to be attributed to the victims themselves. Auto accident and wrongful death attorney Brent T. Ackerson , also a partner in Bahe Cook Cantley & Jones, regularly sees defense attorneys attempt to apportion fault and blame for injuries and deaths from car and truck crashes upon the victims themselves for failures to wear seatbelts. These usually become cases where the question arises of just how much percentage of fault a victim shall be assigned for not wearing his or her seat belt.
