Pfizer Unit Pharmacia and Upjohn May Be Tagged Again For Some Of The Same Allegations As In Mirapex Cases

Philadelphia juries have found that a hormone-replacement therapy drug manufactured by Pharmacia & Upjohn caused breast cancer. Just like with Mirapex, a jury also found Pharmacia & Upjohn failed in adequately warning doctors prescribing the drug to patients about the cancer risks, and that the failure to warn the doctors contributed to the physicians’ decision to prescribe the drugs.

In one case, the jury also decided that Pharmacia & Upjohn’s conduct in marketing and selling the drugs was wanton and reckless because it hid health risks. This led to a punitive damages award that some say was as high as $75 million. A different jury is set to decide the same issue in another case.

These are very similar to the allegation Pfizer and Pharmacia & Upjohn are facing in the Mirapex cases. Likewise, in July 2008, a Minnesota jury awarded $8.3 million in the first, and to date only, trial involving Mirapex. $7.8 million of the award was for punitive damages related to the jury's finding that Mirapex's manufacturer misrepresented the facts associated with the risks of taking the drug.
