Bahe Cook Cantley & Jones auto accident lawyer Larry Jones says, "It isn't clear who is at fault for the unfortunate tragedy. However, one can presume that the driver of the vehicle must have been at fault or he would have stopped and rendered help to this young man."
Under Kentucky law, a pedestrian's first $10,000 of medical bills are paid without regard to fault under Kentucky's no-fault law. These are paid by the insurance company of the car that struck the pedestrian. Beyond that, the driver's liability insurance pays for all damages. If there is no insurance coverage, the pedestrian's insurance company pays if there is "uninsured" or "underinsured" motorist coverage.
