Kentucky Supreme Court Rules Lexington’s Bluegrass Airport Cannot Be Sued

Kentucky’s highest court has upheld a lower court ruling that the Bluegrass Airport is immune from suit by Comair, relating to the August 27, 2006 Flight 5191 crash. The airport is entitled to sovereign immunity, because it is an extension of the Urban County Government.

Comair had sued the airport claiming that the airport should share in the blame for the crash of flight 5191 because of poor runway markings, bad signage, lighting problems and other issues related to runway paving. The airport had maintained that the sole responsibility of the crash rested upon Comair and its pilots. With sovereign immunity being established, the issues of whether the airport may have been at fault will now go unanswered.
