Mount Washington (Bullitt County) KY Auto Accident Severly Injures Two

There was a serious injury auto accident in Mount Washington, Kentucky yesterday that left both drivers hospitalized--one in critical condition and the other in serious, but not life-threatening condition.
State police say Rhonda Robinson of Taylorsville, Kentucky was driving a Ford Mustang east on Ky. 44 when she turned left into the path of a Chevrolet pick-up truck, driven by Donald Dunn, also of Taylorsville, Kentucky. Mr. Dunn was, reportedly, traveling west on Ky. 44 in Mount Washington when Ms. Robinson turned into his path. The vehicles hit head on, and Mr. Dunn was, reportedly, ejected from his truck.
Following the crash, Mr. Dunn was taken to University Hospital by Bullitt County EMS. Ms. Robinson was extricated from her car by the Mount Washington fire department and airlifted to University Hospital, according to KSP.
According to a report in the Louisville Courier-Journal, Mr. Dunn, 47, was in critical condition late Monday night at University Hospital. Ms. Robinson, 44, was also at University Hospital in serious condition.

From a legal perspective, whenever someone is ejected from a vehicle, there's a presumption by many that the person was not wearing a seat belt, but this is not always the case. From the facts reported by KSP, it sounds like the Mustang driver was responsible for causing the wreck. But if a claim is made on Mr. Dunn's behalf, her insurance company may claim that he was not using his seat belt and that seat belt usage would have mitigated his injuries. This is a common defense. Only a proper forensic investigation by experienced professionals can determine whether this is true."
