Deadly Motorcyle Accident in Knox County, Kentucky
There was a fatal motorcycle accident on KY 225 in Knox County, Kentucky on Tuesday.
Kentucky State Police in Harlan Kentucky responded to a motorcycle crash on KY 225 in Artemus, Kentucky in Knox County.
According to their report, a Yamaha motorcycle ridden by 23 year-old Carl Niccum Jr. of Barbourville, Kentucky was traveling north on KY 225 as a backhoe operated by Earnest Sowders of Artemus, Kentucky was stopped northbound on KY 225 attempting to turn left.
Apparently, Mr. Niccum attempted to pass the backhoe as it began turning left and his motorcycle struck the backhoe in the left front. Mr. Niccum was ejected from the motorcycle and sustained serious multiple injuries.
Knox EMS transported him to an open field where he was then stat-flighted to University of Tennessee Medical Center. Mr. Niccum succumbed to his injuries and was pronounced dead at the hospital. This crash is still under investigation by Trooper Shane Jacobs of Kentucky State Police Post 10 in Harlan Kentucky.
Shawn Cantley, a Kentucky lawyer who represents injured cyclists said: "It's difficult to tell from the facts here who was at fault for this tragic wreck. The investigation may reveal that both the cyclists and the backhoe operator shared in the fault. Under Kentucky law we have a comparative fault system that allows liability to be apportioned on a percentage basis."
