Firm Attorney's Case To Be Heard By Kentucky Supreme Court
Louisville, Kentucky attorney Will Nefzger of Bahe Cook Cantley & Jones PLC will be arguing a case at the Kentucky Supreme Court this fall. Nefzger's client was seriously injured on her way home from the Louisville International Airport when the driver of a pickup truck slammed into the rear of her vehicle. The pickup truck driver was on his cell phone when the accident occurred. The injured client suffered a torn rotator cuff and two ruptured discs in her neck. The injuries have required two separate surgeries thus far.
The issue to be decided by the Kentucky Supreme Court deals with whether the injured client was within the course and scope of her employment when the accident occurred, and therefore, entitled to workers' compensation benefits. The Kentucky Court of Appeals unanimously (3-0) decided in favor of Nefzger's client holding that she was within the course and scope of her employment and etitled to workers' compensation benefits.
This will be Nefzger's second trip to the Kentucky Supreme Court over his nine years of practice. In the first case that went up to the state's higest court, argued and decided in 2008, Nefzger won a unanimous (7-0) decision reversing the Kentucky Court of Appeals.
