Two More Families File Lawsuits Against Louisville Zoo for Train Derailment Accident

Based on news reports today, two additional families have filed lawsuits against the Louisville Zoo for the alleged negligent conduct related to the train derailment accident that caused numerous serious injuries. The two families have filed a lawsuit against Chance Rides Manufacturing, Inc. and the train's driver Mary C. Coffey --who allegedly drove the train too fast. According to court records, Chance Rides Manufacturing designed, manufactured, marketed and sold the engine and passenger cars to the Louisville Zoo.

The plaintiffs in the lawsuit are Christopher D. Lankford, Amanda B. Lankford, Hila McKenzie and Chei McKenzie.

The lawsuit claims that the Zoo train was in a defective condition, unreasonably dangerous to the users and consumers thereof at the time of the manufacture, distribution and sale. It also said the negligence of Coffey substantially caused or contributed to the injuries suffered by the plaintiffs, independently and/or concurrently with the negligence of Chance Rides Manufacturing, Inc.

While all certainly seem culpable based upon news reports, it doesn't appear as though anyone has yet sued the individuals or entities who designed the layout of the track. Based upon news reports, it would appear as though the layout of the track may have also been a contributing factor."
